Do Kwon extradition returns to Supreme Court
According to reports published by local media, reviewed by Cointelegraph, The appeals court accepted the appeal filed by Kwon’s defense, who sought to avoid the extradition of the person represented to United States territory.
Therefore, the Supreme Court receives Kwon’s case again to hold a trial and make a decision. “If the person whose extradition is requested gives his or her consent to the extradition, an abbreviated procedure must be applied and in which case the Court decides,” reads in the ruled resolution.
The opinion also establishes that the Superior Court “is obliged to hear the accused again, guaranteeing compliance with the guarantees that the person whose extradition is requested gave his consent voluntarily, knew its consequences, and understanding that the consent given cannot be revoked.”
The difficulties in extraditing Do Kwon
As we have commented in previous editions, Do Kwon’s extradition process has been one of the most controversial, precisely because there has not been an agreement to decide which country will receive him.
Kwon currently remains free on bail after serving his sentence in Montenegro, waiting for a decision on which country will receive him to complete the rest of his process. The accused faces charges and proceedings related to the collapse of the ecosystem of Terra and the losses that this resulted for both millions of investors and users of the tokens produced by the network.
Both the courts and Kwon’s team have appealed the extradition verdicts on countless occasions, so when it appears that a destination country has been chosen, resources are introduced to stop and rethink the process. The accused has expressed his desire to comply with his legal process in South Korea, but the US authorities through the Securities and Exchange Commission (SEC) They have put pressure on him to go to the North American country, where he was already found guilty along with Terraform Labs of civil fraud.
Kwon’s lawyers have managed to prevent their client from going to the US, alleging pressure from the US government to violate due process.
