What changes, who are the main affected and how does it affect private citizens?



The instant payments are increasingly common in Spanish society not only among private citizens to settle accounts for a dinner, a gift or the purchase of tickets for an event of any kind; but also in stores and to pay for the services of self-employed professionals.

Not in vain, Bizumthe popular company specialized in instant money sending, broke records in 2024 with almost 1.1 billion operations throughout the year – about three million daily transactions and around 35 shipments every second -, with an economic value of 44,206 million euros. That flow of money, until now in tax limbo, is what the Ministry of Finance wants to control in 2026 with the aim of combating tax fraud and ensure income traceability, as reflected in the Royal Decree 253/2025, of April 1.

The news, however, has generated tremendous concern in recent days among the citizens of our country, fearful that due to shift bizum of 50 euros to your children or family members The Tax Agency inspects their accounts and everything ends in a financial fine when they understand that it is a donation. What does the law say now?

At this time, the regulations establish that Banks must inform the Treasury of charges exceeding 3,000 euros carried out through cards and other payment systems -such as bizum-, which means that operations of smaller amounts were left out of the tax radar.

What changes with this new Treasury regulation?

The main novelty is the elimination of that threshold, so all operations linked to an economic activity will have to be communicated. Thus, starting in February 2026, financial entities will report these movements to the Tax Agency monthly.

Who are the main people affected by this measure?

Companies -mainly SMEs- and self-employed professionals -self-employed- that they receive by any means of payment, including the popular ones bizums, income into their bank accounts as consideration for any good or service offered.

What information must banks provide?

Financial entities must report monthly on: the complete identification of the businessmen or professionals attached to the collection management system through Bizum or equivalent systems; business number with which they operate; sales terminals; monthly amount invoiced; and everything related to bank or payment accounts through which payments are made by businessmen and professionals.

And what happens then with individuals? Should bizums declare?

In principle, this new regulation does not affect private citizens if there is no link to an economic activity. “Only charges received by businessmen and professionals established in Spain must be declared. Collections between individuals are thus excluded.“, the Treasury stated in an explanatory note with which it wanted to reassure all public opinion.

Are there any aspects of the regulations that affect individuals?

“The banks will report to the Tax Agency accumulated monthly information of each businessman or professional, the information will not be sent operation by operation,” the Treasury makes clear. However, Asufin, the association of financial users in Spain, points out two specific cases for payments or withdrawals of money, which do affect individuals but are not specifically related to Bizum. “LBanks must report annually on payments made by card whose amount exceeds 25,000 euros. as well as cash withdrawals by individuals that exceed 3,000 euros.”

Regardless of the regulation, how does Bizum affect individuals?

“If they are habitual day-to-day movements – dinners, trips or purchases made together – that do not generate returns, nor do they imply an increase in taxable assets, they should not be declared – no matter how much the figure of 10,000 euros has transcended, which is the one used, normally as a reference threshold in the prevention of money laundering,” explains Asufin. However, “If the income constitutes the consideration for a sale or service operation -the payment of rent, for example- or a donation between individuals, the tax treatment is that of these operations, regardless of the means of payment.”

When was this modification approved?

In April 2025. “Since then a permanent contact with financial institutions and the Tax Agency has been reporting the limited scope of this modification in relation to payments with Bizum,” the Treasury has stated.
